On the 27th, the National Internet Information Office issued the Administrative Provisions on Internet Information Service Algorithm Recommendation (Draft for Comment) (hereinafter referred to as "Draft for Comment") for public comment.
The opinion draft puts forward:
Algorithm recommendation service providers should adhere to the mainstream value orientation, optimize the algorithm recommendation service mechanism, actively spread positive energy, and promote the upward application of algorithms.
The algorithm recommendation service provider shall regularly review, evaluate and verify the mechanism, model, data and application results of the algorithm, and shall not set up an algorithm model that induces users to indulge or spend too much, which violates public order and good customs.
The algorithm recommendation service provider shall not record illegal and bad information keywords in user interest points or use them as user tags to push information content, and shall not set discriminatory or biased user tags.
Algorithm recommendation service providers should strengthen the ecological management of algorithm recommendation service pages, establish and improve the mechanism of manual intervention and user’s independent selection, and actively present information content that conforms to mainstream value orientation in key links such as home page first screen, hot search, selection, list category and pop-up.
Algorithm recommendation service providers shall not use the algorithm to falsely register accounts, illegally trade accounts, manipulate user accounts, or falsely praise, comment, forward, navigate the web, etc., to implement traffic fraud and traffic hijacking; It is not allowed to use algorithms to block information, over-recommend, manipulate lists or sort search results, control hot search or selection, and interfere with information presentation, implement self-preferential treatment, unfair competition, influence online public opinion or evade supervision.
The algorithm recommendation service provider shall not push the information content that may cause minors to imitate unsafe behaviors and violate social morality, induce minors’ bad habits, etc., and shall not use the algorithm recommendation service to induce minors to indulge in the network.
If the algorithm recommends that service providers provide work scheduling services to laborers, they should establish and improve relevant algorithms such as platform order distribution, remuneration composition and payment, working hours, rewards and punishments, and fulfill the obligations of safeguarding laborers’ rights and interests.
In addition, the phenomenon of "big data killing" often attracts attention. The opinion draft proposes that if the algorithm recommends that service providers sell goods or provide services to consumers, they should protect the legitimate rights and interests of consumers, and should not use the algorithm to implement unreasonable differential treatment and other illegal acts on trading conditions such as trading prices according to the characteristics of consumers’ preferences and trading habits.
According to reports, the application of algorithm recommendation technology refers to the application of algorithm technologies such as generating synthesis class, personalized push class, sorting selection class, retrieval filtering class and scheduling decision class to provide information content to users.
