The exposure draft proposes that,

No organization or individual may send commercial short messages or make commercial phone calls to users without their consent or request, or if users explicitly refuse.

If the user does not explicitly agree, it shall be regarded as refusal.

If the user expressly refuses to receive after agreeing, it shall stop.

When a short message service provider sends a port-type commercial short message, it shall ensure that the relevant user has agreed or requested to receive it, and keep the user consent certificate for at least five months.

Short message service providers shall not change the use of telecommunication network code number without authorization, and shall not use the port for sending business management and service short messages for sending commercial short messages, and shall not restrict users from receiving business management or service short messages without justifiable reasons.

In addition, the Ministry of Industry and Information Technology will organize the establishment of a national unified "call rejection" platform to guide relevant organizations or individuals to respect users’ wishes and standardize commercial calls. Operators of basic telecommunications services should rely on the "call rejection" platform to provide "call rejection" services, register users’ willingness to receive commercial calls in a convenient and effective way, and provide anti-intrusion services according to users’ wishes and agreements between the two parties.

Regarding user complaints, the draft for comments was put forward.

The Ministry of Industry and Information Technology entrusts internet society of china 12321 Network Bad and Spam Reporting Acceptance Center (hereinafter referred to as 12321 Acceptance Center) to accept users’ complaints about short message service or voice call service.

Users who think that they are harassed by commercial short messages or commercial telephone calls, or receive short messages or telephone calls containing prohibited contents stipulated by laws and regulations, can complain to the 12321 acceptance center.

For complaints with complete and accurate information, the 12321 acceptance center shall forward them to relevant enterprises for verification and handling within 3 working days after receiving the complaints. Relevant enterprises shall, after verification, take effective measures in time, and report the disposal results to the 12321 acceptance center within 15 working days. 12321 Acceptance Center will feed back the processing result to the user within 3 working days after receiving the processing result.
