  CCTV News:The Supreme People’s Court held a press conference on the morning of 17th, and released the Interpretation of the Supreme People’s Court on Relevant Issues Concerning the Application of Law in the Trial of Cases Involving Husband and Wife Debt Disputes. There are 4 explanations, which will come into force on the 18th of this month. This judicial interpretation, which has only four articles, has only one main purpose, that is, to clarify the criteria for determining the joint debt of husband and wife.

  Article 1 of the Interpretation stipulates: "The debts that are jointly signed by the husband and wife or ratified by one of the husband and wife afterwards shall be recognized as joint debts of the husband and wife."

  The people’s court shall support the debts incurred by a husband and wife in their own name for the daily needs of the family during the marriage relationship, and the creditors claim their rights on the grounds that they belong to the joint debts of husband and wife.

  In view of the fact that a large number of debts incurred by a husband and wife in their own name exceed the daily needs of the family are joint debts of husband and wife. The judicial interpretation released today clarifies the criteria for determining this kind of debt.

  Article 3 of the Interpretation stipulates: "If one of the spouses exceeds the daily needs of the family in his own name during the marriage relationship, the people’s court will not support the creditor’s claim on the grounds that it belongs to the joint debt of the husband and wife, but the creditor can prove that the debt is used for the husband and wife’s common life, joint production and operation, or based on the common will of both husband and wife."
